Joey Ebanks to face legal action for Facebook postings

Joey Ebanks, suspended head of the Cayman Islands Electricity Regulatory Authority and facing a criminal investigation, will now face legal action over comments he has made on his Facebook page.

Ebanks is also standing for election in North Side, a seat held by MLA Ezzard Miller, who is one of the persons threatening legal action against him.

Cayman Islands Governor Duncan Taylor is also threatening to sue him.

Now, Layman Daniel Scott, Chairman of the Judicial and Legal Services Commission, has filed a lawsuit against Ebanks, for libel and slander, claiming Ebanks wrote false and malicious statements on Facebook concerning him.

The writ also says Ebanks defamed Scott at a public meeting on 6 April. Scott claims these alleged malicious statements were said to damage his character. He is claiming damages for libel and slander and asking for an injunction to prevent Ebanks from publishing or saying anything defamatory about him.

He is also asking for any costs necessary.

Ebanks has said it his mission to “stamp out corruption” in Cayman. He has posted a host of accusations against several high-profile figures, saying he will continue to deliver “beat downs” on his Facebook page.

Scott’s lawyers previously delivered a “cease and desist” letter to Ebanks and iNews Cayman received a warning letter from them advising us not to publish Ebanks’ Facebook comments.

Miller has also filed a complaint with the Information and Communications Technology Authority against radio station VIBE FM. On one of the station’s radio shows Ebanks made a number of remarks about the North Side MLA.

There have been a number of successful law suits in the United Kingdom against persons making defamatory and libelous remarks on Facebook but this will be the first time in the Cayman Islands anyone has threatened or taken out similar action.
