Court of Appeal finds in favour of CAACI
(George Town, Grand Cayman) 26 March 2014 – The Civil Aviation Authority of the Cayman Islands (CAACI) was vindicated today for its certification of the Cayman Islands Helicopter (CIH) heliport on North Church Street, George Town, Grand Cayman. In a ruling handed down by the Honourable Chief Justice Anthony Smellie on 24 May 2013 following a judicial review filed in the Grand Court by Axis International Ltd., he ruled that the CAACI did not properly satisfy itself that all the regulatory requirements for certification were complied with and ordered that the Authority reassess the Heliport to decide whether or not the certification should stand.
The CAACI appealed the Chief Justice’s ruling and in a verdict rendered today by the Court of Appeal, the Court found that “In arriving at the decision to grant a certificate the Authority did not at any stage act unreasonably” and allowed the appeal.
