Devon Anglin loses appeal
On Friday (7) the Cayman Islands Court of Appeal dismissed convicted killer, Devon Anglin’s appeal.
Anglin (26) was convicted by Chief Justice, Anthony Smellie, earlier this year, in a trial by judge alone, for the murder of 36 year old Carlo Webster at the Next Level Night Club.
Mr. Webster and another man were shot at the Club on a Friday night/Saturday morning in September, 2009. There was an estimated 300 persons in the club at the time of the shooting.
For the first time in the Cayman Court, anonymous witness orders were issued by Justice Charles Quin.
The Chief Justice heard evidence via a video link from two witnesses in an unknown location and they were named as Witness A and Witness B. The rest of the courtroom, including Anglin and his attorneys, only heard their voices that were altered electronically to prevent further identification.
Anglin’s appeal was presented by his attorneys Dorian Lovell-Pank and Lucy Organ.
They claimed the evidence as was presented at the trial was inconsistent or contradictory. They said after the Crown had called all of its evidence, but before they closed their case, the Defence had asked the judge to lift the anonymity orders but he had refused their application. By failing to lift the orders the Defence argued the defendants right to examine the witnesses properly had been compromised and that had made the trial unfair.
The appeal court judges did not give any detailed reasons why they had dismissed the appeal.
