TOPIC: Comparing credit & insolvency issues – BVI vs Cayman Island

The seminar will compare the treatment of credit and insolvency issues in the British Virgin Islands and Cayman Islands. Within this broad heading it will focus on topics such as the key similarities and differences between winding-up procedures in the two jurisdictions, the different approaches to the insolvency test and the treatment of priority of claims and insolvency set-off. The seminar will also cover voidable transactions (including under non-insolvency avoidance laws), directors’ liability and restructuring options in the BVI and Cayman Islands. Any in-house counsel who come across BVI and Cayman entities in their business dealings should attend this helpful seminar to learn about the key cornerstones of BVI and Cayman insolvency law and understand what can be done when structuring and documenting transactions to improve credit risk and rating and minimise exposure on insolvency of BVI or Cayman counterpart.

SPEAKERS:

Ian Mann – Head of Harneys’ BVI and Cayman Litigation and Restructuring Department; Partner. Ian Mann is head of Harneys’ BVI and Cayman Litigation and Restructuring Department in Hong Kong servicing Asia based clients involved in BVI and Cayman litigation. Ian specialises in insolvency, restructuring, shareholders’ disputes and contentious trusts (Ian is also a TEP). Ian is one of the general editors of British Virgin Islands Commercial Law, Sweet & Maxwell, now in its third edition.

Ellie Crespi- Senior Associate, Banking and Finance transactions. Ellie advises on Cayman Islands and British Virgin Islands law, on banking and finance transactions and corporate matters, restructurings and insolvencies. She advises top tier law firms, major international financial institutions and corporates on all aspects of credit and security issues. Her recent practice has focused on asset-based lending, distressed debt sales and statutory mergers.
