The Editor Speaks: How right the Court of Appeal is
In the case of the 51 year old former corporate lawyer Simon Courtney who ran into an elderly couple, Cathy and Richard Schubert, causing GBH when they were visiting the Cayman Islands in 2015 and crashed his souped-up Mustang near the Ritz-Carlton where he had been eating and drinking, the Appeal judges rejected all 8 grounds submitted for the Appeal.
How RIGHT they were. Never in all my long life have I ever read a case involving a lawyer who refuses to admit he has done a terrible wrong to an aged couple who were here on holiday. His defense was so ridiculous it would have made an Enid Blyton children’s book about Noddy more believable.
I was hoping the Appeal Court might say the sentence given to him of three years in jail was too light and added more but you can’t have everything. It is obvious, however, the time Courtney has served in prison has not made him see the error of his behaviour nor become remorseful.
In rejecting his ludicrous Appeal the court said that “the sentence was not even arguably manifestly excess”!
Courtney had fled the scene of his carnage and hidden himself away before appearing the following morning. He claimed not to have been drunk and had gone to get help for the poor victims he had mowed down whilst they were walking on the sidewalk and had passed out in a field.
He has also been convicted of a separate incident before this one of DUI and despite the conclusive evidence against him has appealed it.
In Courtney’s eyes he can do no wrong. He is above the law. He is God’s chosen one.
Because of the new Conditional Release Law he will be eligible for release next year in April. Because he is a lawyer no doubt he will get his reward.
Unfortunately for him he will get a different reward when he dies and appears before his Maker. No doubt Courtney will believe he is the superior being of the two.
Thank you Appeals Court judges. You got this one right in my book. Thank you.
